1. About MediArca

MediArca is a digital health infrastructure platform designed to help individuals securely organize, manage, access, and share medical records and health-related information.

MediArca acts solely as a technology platform. MediArca is not:

  • A hospital
  • A clinic
  • A healthcare provider
  • A diagnostic center
  • An insurance provider
  • An emergency medical service
  • A medical practitioner

The Services are intended to facilitate health record management and information accessibility.

2. Eligibility

To use the Services, you must:

  • Be legally capable of entering into a binding agreement.
  • Provide accurate and current information.
  • Comply with applicable laws and regulations.

Parents or legal guardians may manage records on behalf of dependents where permitted by applicable law.

3. User Accounts

Users may be required to create an account to access certain Services. You are solely responsible for:

  • Maintaining account confidentiality.
  • Protecting login credentials.
  • Restricting unauthorized access.
  • Activities occurring under your account.

You agree to notify MediArca promptly if you suspect unauthorized access or a security breach.

4. Healthcare Professional Accounts

MediArca may provide accounts for doctors, clinics, and healthcare professionals. Healthcare professional accounts may be subject to verification procedures including identity verification, clinic verification, credential review, practice verification, or other validation methods determined by MediArca.

Verification performed by MediArca is intended solely to improve platform security and trust. Verification does not constitute:

  • Medical endorsement
  • Certification
  • Recommendation
  • Licensing guarantee
  • Quality assurance
  • Clinical evaluation

Users remain responsible for independently evaluating healthcare professionals.

MediArca reserves the right to approve, reject, suspend, restrict, or revoke healthcare professional accounts at its sole discretion.

5. Ownership of Medical Records

Patients retain ownership and control of their personal health information and medical records stored on or managed through MediArca.

MediArca does not claim ownership of:

  • Prescriptions
  • Diagnostic reports
  • Laboratory reports
  • Medical images
  • Insurance records
  • Health documents
  • Other patient-generated or provider-generated records

By using the Services, users grant MediArca a limited, non-exclusive license to store, process, transmit, analyze, display, and manage such information solely for providing and improving the Services.

6. Accuracy of Records

MediArca does not verify, validate, audit, or guarantee the accuracy, completeness, authenticity, reliability, or clinical correctness of records uploaded by patients, healthcare professionals, clinics, hospitals, laboratories, insurers, or other third parties.

Records available through MediArca are only as accurate as the source documents provided. Users are responsible for reviewing and verifying information before relying upon it.

7. Sharing of Records

Users may choose to share medical records with:

  • Healthcare professionals
  • Family members
  • Caregivers
  • Authorized representatives
  • Other individuals authorized by the user

By sharing records, users acknowledge that:

  • They have authority to share the information.
  • They understand the permissions being granted.
  • Recipients may retain copies of shared information.
  • MediArca is not responsible for actions taken by authorized recipients after information has been shared.

8. AI-Powered Features

MediArca may utilize artificial intelligence, machine learning, automated systems, and related technologies to provide features such as:

  • Medical record summarization
  • Information extraction
  • Document categorization
  • Search assistance
  • Record organization
  • Administrative support features

AI-generated outputs are informational in nature and may contain inaccuracies, omissions, errors, misinterpretations, or outdated information. Users acknowledge that AI technologies are inherently probabilistic and may not always produce complete or accurate results.

AI-generated outputs must not be relied upon as a substitute for professional medical advice, diagnosis, treatment, or clinical judgment. Users assume all risks associated with reliance upon AI-generated outputs.

9. No Medical Advice

Nothing available through MediArca constitutes:

  • Medical advice
  • Diagnosis
  • Treatment recommendations
  • Clinical opinions
  • Professional healthcare services
  • Emergency medical services

Healthcare decisions should always be made in consultation with qualified healthcare professionals.

If you are experiencing a medical emergency, immediately contact emergency services or a qualified healthcare provider. MediArca is not intended for emergency use.

10. Beta Services and Early Access Features

MediArca is an evolving platform. Certain Services, integrations, APIs, AI features, workflows, or functionalities may be designated as:

  • Beta
  • Pilot
  • Experimental
  • Preview
  • Early Access
  • Testing Features

Such features are provided for evaluation, testing, product improvement, and user feedback purposes. Users acknowledge that Beta Services:

  • May contain bugs or defects.
  • May not function as intended.
  • May be interrupted or discontinued.
  • May generate inaccurate results.
  • May undergo substantial changes without notice.

Users voluntarily participate in Beta Services and assume associated risks. MediArca shall not be liable for losses arising from Beta Services.

14. Data Backup Responsibility

MediArca does not guarantee protection against all forms of data loss.

15. User Support and Dispute Resolution

If a user believes there is an issue including inaccurate information, unauthorized access, data discrepancies, security concerns, AI-generated errors, verification concerns, or technical issues — the user agrees to first notify MediArca through official support channels and provide reasonable details regarding the issue.

MediArca shall be given a reasonable opportunity to:

  • Investigate the issue.
  • Verify information.
  • Request supporting documentation.
  • Implement corrective measures where appropriate.
  • Respond to concerns.

Users acknowledge that many issues may arise from source records, user actions, healthcare providers, third-party systems, or circumstances beyond MediArca's direct control. Nothing in this section limits rights available under applicable law.

16. Intellectual Property

All MediArca software, branding, logos, designs, interfaces, technologies, content, and related intellectual property are owned by or licensed to MediArca.

Users may not reproduce, distribute, modify, reverse engineer, or exploit MediArca intellectual property without authorization.

17. Feedback

Any suggestions, feature requests, comments, evaluations, bug reports, or feedback submitted to MediArca may be used by MediArca without restriction or compensation.

MediArca is under no obligation to implement submitted feedback.

18. Limitation of Liability

To the fullest extent permitted by law, MediArca, its founders, employees, advisors, affiliates, contractors, and partners shall not be liable for:

  • Medical outcomes
  • Healthcare decisions
  • AI-generated inaccuracies
  • Data loss
  • Service interruptions
  • Third-party failures
  • Security incidents beyond reasonable control
  • Lost profits
  • Loss of opportunity
  • Indirect, incidental, special, consequential, or punitive damages

If liability cannot be excluded by law, MediArca's total aggregate liability shall not exceed the greater of: (a) the amount paid by the user to MediArca during the preceding twelve months; or (b) INR 1,000.

19. Indemnification

Users agree to defend, indemnify, and hold harmless MediArca, its founders, employees, advisors, affiliates, contractors, and partners from claims, liabilities, losses, damages, expenses, and costs arising from:

  • User-generated content
  • Misuse of the Services
  • Violation of these Terms
  • Violation of applicable law
  • Infringement of third-party rights

20. Force Majeure

MediArca shall not be liable for delays or failures caused by circumstances beyond reasonable control, including:

  • Infrastructure failures
  • Third-party service disruptions

21. Suspension and Termination

MediArca may suspend, restrict, remove content from, or terminate accounts at its sole discretion where reasonably necessary to:

  • Comply with legal obligations

22. Changes to Terms
